DRAFT : Agreement between the Care Provider (the supplier) the Customer (the searcher) and the LWDP
CareSeeker (Lancashire) web site is offered to you, the customer, by LWDP based at Marion House, Beech Rd, Preston, United Kingdom. Your use of this Web site and/or your acceptance of the terms, conditions, and notices (without modification) contained herein constitutes your agreement to all such terms, conditions, and notices. If you do not agree with these terms and conditions then you are not authorised to use this Web site.
Privacy policy
Because your privacy is important to us, The LWDP operates on these principles:
Care Providers
(1) CareSeeker (Lancashire) is a searchable directory of Care Provider Organisations who are members of the LWDP. Membership is currently defined as any provider of Social Care who provide services to the people of Lancashire or who's care is purchased by Lancashire County Council. All known members organisations are listed on LancashirePlan, the organisational details being obtained from publicly available sources. CareSeeker (Lancashire) basic organisational details are populated from LancashirePlan and other information in the public domain.
(2) No individuals details other than individuals identified from publicly available sources have been pre populated into CareSeeker (Lancashire).
(3) All values can be edited or amended by accredited people within your organisation.
(4) Only publicly available information or information provided by you for the explicit use within CareSeeker (Lancashire) will be made available to customer. This information will not be given or sold in bulk for the purpose of marketing
(5) You can request that your organisation does not feature in CareSeeker (Lancashire).
Customer
(1) We explicitly ask when we need information that personally identifies you . For example, if you wish to register with CareSeeker (Lancashire), The LWDP asks you for your name and email address. We use your email address to verify your identity, protect against fraud and to contact you regarding CareSeeker (Lancashire). We provide your Personal Information to necessary third-party service providers when you search for services through the LWDP's CareSeeker (Lancashire). We also use your Personal Information to operate CareSeeker (Lancashire) and occasionally, to inform you of new features, services, and products from the LWDP.
(2) The LWDP may use your personal information to send you information on company updates, other services and products available from The LWDP and companies under our control which may be of interest to you. This information will be sent either directly to you by The LWDP and companies under our control or on our behalf by third parties. We also use your email address to send you updates about your account. We may use URL information we collect to help direct advertising to you that is more likely to be of interest to you. If you do not wish to receive such offers from The LWDP or have your personal information used in any of the ways outlined above you may opt out by indicating as appropriate on the registration page. You may also opt out at any time by sending an email to rob@accessplanit.com. This opt out also applies to the Care Providers and customers. The LWDP/ AccessPlanIT Ltd use your IP address to help diagnose problems with our server and to administer CareSeeker (Lancashire).
(3) The LWDP may disclose Personal Information if required to do so by law or in the good-faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on The LWDP or the site; (b) protect and defend the rights or property of The LWDP, the site or the users of, and (c) act under exigent circumstances to protect the personal safety of users of The LWDP, the site or the public.
(4) To make sure that your Personal Information for your registration is correct and current, you may review and update your customer information at any time.
If at any time you believe that The LWDP has not adhered to these principles, please notify us by email to info@lwdp.org.uk, and we will use all commercially reasonable efforts to determine and correct the problem promptly. Customer - This Web site is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web site.

Advertisers are reminded that the contract is between the guest and the owner and The LWDP cannot be held responsible for any subsequent claims thereby arising as a result of guest conduct.
The LWDP may, and you may not, assign, convey, subcontract or delegate rights, duties or obligations hereunder.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and The LWDP as a result of this agreement or use of this Web site.
The LWDP's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of The LWDP's right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by the LWDP with respect to such use.

This agreement constitutes the entire agreement between the care provider, the customer and the LWDP with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the customer and The LWDP with respect to this Web site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Fictitious names of companies, products, people, characters, and/or data mentioned herein are not intended to represent any real individual, company, product, or event.
